City of Oneida Site Plan
Ordinance
Approval of site plans by resolution of the Planning Board is
required as a condition for the issuance of a zoning permit and/or
building permit for the development of any new use, the construction
of any new structures, any change of an existing use of land or site
and all other building or development activities in A, R-2, R-3, B,
C, M-I, R-P and MDP zoning districts.
Site plan review, as provided for in the City
of Oneida Site Plan Ordinance, any other provisions notwithstanding,
shall apply to:
The
Planning Board, when acting upon applications for site plan
approval, shall have the power to grant such exceptions from the
requirements for site plan approval as may be reasonable and within
the general purpose and intent of the provisions for site plan
review and approval of this ordinance, if the literal enforcement of
one or more provisions of the ordinance is impracticable or will
exact undue hardship because of peculiar conditions pertaining to
the land in question.
Site plan review
will not be required for the following:
Construction or
erection of permitted single or two (2) family homes and
additions to such, as well as, structures accessory to single or
two (2) family residences;
Construction or
erection of permitted accessory buildings and structures less
than one-hundred (100) square feet in an area accessory to a
multiple family, commercial, office, essential service,
municipal or industrial use;
Grading, excavation,
filling, soil removal, creation of ponds or clearing of trees
within an area of up to five hundred (500) square feet, provided
such activity is normally and customarily incidental to
single-family uses on the site;
Any interior work or
improvements;
