City of Oneida Site Plan Ordinance 

Approval of site plans by resolution of the Planning Board is required as a condition for the issuance of a zoning permit and/or building permit for the development of any new use, the construction of any new structures, any change of an existing use of land or site and all other building or development activities in A, R-2, R-3, B, C, M-I, R-P and MDP zoning districts. 

Site plan review, as provided for in the City of Oneida Site Plan Ordinance, any other provisions notwithstanding, shall apply to: 

1. New construction, excluding single and two-family residences;
2. All additions to existing structures (with the exception of single and two (2) family homes), which will result in an increase of existing floor area, including  multiple floors, if such exist, in excess of ten percent (10%) or one thousand (1000) square feet, whichever is the lesser;
3.   Any development, except single and two (2) family residential, for which off-street parking areas are provided, as required by this Ordinance;
4.   Development of any non-single or two (2) family use or building in any residential district;
5.   Development of any non-residential use or building;
6.   Cellular phone towers;
7.   Essential public service buildings and storage areas;
8.   The erection, relocation, conversion or structural alteration to any non-single or two (2) family building, structure or site which results in additional floor space;
9.   Any development which would establish more than one (1) principal use on a single lot; (Example: a single family site condominium or similar project where a single parcel is to be developed with more than one (1) detached dwelling unit);
10.   Any change in the use of land or  building to a different class or type to a more intensive use, which may involve significant changes to features such as building appearance, parking needs, traffic flow and /or volumes, noise, drainage, hours of operation, buffering/landscape needs, effluent discharge and other similar impacts.

The Planning Board, when acting upon applications for site plan approval, shall have the power to grant such exceptions from the requirements for site plan approval as may be reasonable and within the general purpose and intent of the provisions for site plan review and approval of this ordinance, if the literal enforcement of one or more provisions of the ordinance is impracticable or will exact undue hardship because of peculiar conditions pertaining to the land in question. 

  Site plan review will not be required for the following: 

1. Construction or erection of permitted single or two (2) family homes and additions to such, as well as, structures accessory to single or two (2) family residences; 

2. Construction or erection of permitted accessory buildings and structures less than one-hundred (100) square feet in an area accessory to a multiple family, commercial, office, essential service, municipal or industrial use; 

3. Grading, excavation, filling, soil removal, creation of ponds or clearing of trees within an area of up to five hundred (500) square feet, provided such activity is normally and customarily incidental to single-family uses on the site; 

4.  Permitted family foster care homes, family day care homes and adult day care homes in single family zoning districts; 

5. Home businesses or occupations; 

6. Temporary uses, sales and seasonal events; 

7. Improvements to outdoor recreational uses and parks; 

8. Expansion, replanting or alterations of landscaping areas, consistent with the other requirements of this Ordinance; 

9.   Any interior work or improvements; 

10. Improvements or installations of walls, fences, lighting or curbing, consistent with the other requirements of this Ordinance;

11. Alterations to the off-street parking layout or installation of pavement or curbing improvements, of an approved project, provided that the total number of parking spaces remain constant; 

12. An existing building and site that are to be re-occupied by a use permitted in the subject zoning district and that the new use will not require any significant changes in the existing site facilities such as parking, lighting or curbing, consistent with the other requirements of this Ordinance; 

13. An increase in the floor area on the subject site by up to one thousand (1000)square feet or ten percent (10%) of the existing floor area, whichever is less, with no required increase in parking area.
